Fair Opportunity (FAR 16.505(b))

Under FAR 16.505(b)(1), the contracting officer must provide each awardee a fair opportunity to be considered for each order exceeding the micro purchase threshold under multiple delivery order or multiple task order contracts, except as provided in FAR 16.505(b)(2). The ordering contracting officer selects the competition method and documents the basis for award. Under FAR 16.505(b)(2), fair opportunity need not be provided when:

  • The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays;
  • Only one awardee is capable of providing the supplies or services required at the level of quality required because they are unique or highly specialized;
  • The order must be issued on a sole source basis in the interest of economy and efficiency as a logical follow on to an order already issued under the contract, provided all awardees were given a fair opportunity to be considered for the original order;
  • It is necessary to place an order to satisfy a minimum guarantee;
  • A statute expressly authorizes or requires that the purchase be made from a specified source; or
  • In accordance with FAR 19.504, the contracting officer sets aside the order for small business concerns.

Any exception must be justified and documented by the ordering contracting officer as required by FAR 16.505(b)(2)(ii).

How to Obtain a Quote

The SEWP Quote Request Tool (QRT) is the recommended method for obtaining quotes. The QRT, available at www.sewp.nasa.gov, sends a request to every Contract Holder in the selected category or group, documents fair opportunity automatically, and keeps all responses in one place.

  1. Prepare a Statement of Work, Performance Work Statement or service description. If you are unsure of scope, send an overview to help@sewp.nasa.gov for a scope review.
  2. Submit the request through the QRT and select Category B, Group B2 (80TECH26D1121) or Category C (80TECH26D0374).
  3. ExterNetworks responds with a quote that identifies labor categories, hours, rates and any ancillary items, at or below SEWP contract prices.

Hardware and software are quoted only as ancillary items that support a services requirement and that are on the ExterNetworks SEWP VI contract. Include them in the QRT services request or attach a bill of materials. ExterNetworks quotes only items and services on its SEWP VI contracts, and every quote states its validity period; orders placed within that period are honored at the quoted price.

Placing an Order

  1. The contracting officer evaluates quotes and documents the selection under FAR 16.505(b).
  2. The order is issued on any valid federal delivery or task order form and must cite the ExterNetworks contract number (80TECH26D1121 or 80TECH26D0374).
  3. Send the order to the SEWP PMO through the SEWP ordering process and to the Program Manager at malik.sewp@externetworks.com. The PMO reviews, processes and tracks orders; it does not issue them.
  4. ExterNetworks acknowledges the order, assigns a Task Order Project Manager and schedules a kickoff with the ordering agency.

Installation, Warranty and Support Policies

Installation

Installation, configuration and integration requirements are defined in each order. The assigned Task Order Project Manager schedules the work with the agency, coordinates site access and delivers acceptance documentation when installation is complete.

Basic Warranty

ExterNetworks services are performed in accordance with the order and are corrected at no additional cost if they fail to conform to its requirements. Ancillary hardware and software carry the manufacturer or publisher standard commercial warranty unless the order states otherwise; warranty terms are listed on each quote.

Extended Warranty

Extended warranty and maintenance coverage offered by the manufacturer is available as a separately priced line item on the quote and order. ExterNetworks registers the coverage and coordinates any claim with the manufacturer on the agency's behalf for the life of the coverage.

Technical Support

Technical support for delivered services is provided through the Task Order Project Manager and the Post Delivery Support contact below, and through the ExterNetworks service line at 732.624.1900 or toll free 877.825.1575. Service levels and coverage hours are as specified in each order.

Software Support

Software support, maintenance and subscription renewals are provided according to the publisher's support terms and are quoted as separate line items. ExterNetworks serves as the agency's single point of contact, opens and tracks cases with the publisher, and notifies the agency in advance of renewal dates.

Troubleshooting and Resolving Order Issues

  1. Contact Customer Service and Order Troubleshooting (below) by email or phone with the order number, the contract number and a description of the issue.
  2. ExterNetworks acknowledges the issue within one business day, assigns an owner and provides a corrective action plan with a target resolution date.
  3. If the issue is not resolved by the target date, it is escalated to the Program Manager, Malik Zakaria, at (732) 624-1761 or malik.sewp@externetworks.com.
  4. If the agency is not satisfied with the resolution, report the issue to the NASA SEWP PMO at help@sewp.nasa.gov or (301) 286-1478. ExterNetworks will work with the PMO until the issue is closed.
